On motion James S Roberts was this day appointed administrator of the Estate of Alexander B. Averry, deceased, whereupon the said James S. Roberts came into Court and entered into Bond the sum of one thousand dollars with J.S. Babb and R.T.S. Averry as his securities who severally acknowledged in open court approved by the court and ordered to be recorded the said James S. Roberts was duly qualified as administratior and it is further ordered that letters of administration issue to the said James S. Roberts

NOTE: RTS Averry is Sarah Elizabeth's uncle and I believe the deceased Alexander was his son, born 1837. RTS' wife was Mary "Polly" Babb. This is included here until I figure out my Babbs, and know how exactly this J.S. Babb connects to RTS' wife and/or Sarah E's husband.

On motion Henry Babb was this day appointed Administrator of John B.G. Babb deceased thereupon said Henry Babb came into court and entered into Bond in the sum of one thousand dollars with J.S. Babb and J.F. Averry as his securities which Bond was severally acknowledged in open Court approved by the Court and ordered to be recorded. And it is further ordered that letters of Administration issue to the said Henry Babb and the said Babb was qualified as administrator of JBG Babb deceased.

Note: John B.G. Babb was the son of Sarah A.E. Avery Babb and Henry Babb.

1-1-1883 Guardian Bond for Martha E. Babb (as transcribed by Natalie Huntley for the Crockett County page of TNGenWeb): "We, Henry Babb, S. Avery and T.H. Avery, are hold and firmly bound to the State of Tennessee in the penal sum of one thousand dollars...whereas the above bound Henry Babb his this day renewed his bond as Guardian of Martha E. Babb. Minor heir of E.G/E.Y? Babb, deceased. Now if the said Henry Babb shall well and truly perform the duties which are or may be required of him by law as such Guardian, then his obligation to be void; otherwise to remain in full force and virtue...

(NOTE: John BG Babb's wife was Elizabeth, hence the minor heir of EG/EY Babb? 1860 census shows two Martha Babbs within the Henry Babb household, one 10, the other 5, and Henry's son John is age 14. By 1870 Gibson District 4 has a JBG Babb whose age matches Henry's son, and he has a 4-yr-old daughter, Martha. In 1872 Henry is administering his son's estate. In the 1880 census Henry has granddaughter Mattie, age 14, who matches the daughter of his son, John. Thus believe this Martha is Sarah's granddaughter, and John's daughter, age about 17.)

 

1-4-1886 Guardian bond for Sarah, Azzie, Henry and Austin Spencer, Crockett County

We, W.S. Babb, R.T. Smith and J.S. Roberts are held and firmly bound to the state of Tennessee in the penal sum of six hundred dollars...this 4th day of January AD 1886. The condition of the above obligation is such that whereas the above bound W.S. Babb has been appointed Guardian of Sarah, Spencer, Azzie Spencer, Henry Spencer and Austin Spencer minor heirs of Wm. Spencer deceased. Now if the said W.S. Babb shall well and truly perform the duties which are or may be required of him by law as such Guardian, then this obligation to be void; otherwise to remain in full force and virtue...(signed W.S. Babb, R.T. Smith, J.S. Roberts)....

        Another legal paper gives W.S. Babb legal authorization to take into his possession for the benefit of his wards (the Spencer kids named above) "the profit of the lands, tenements and hereditaments belonging to the said ward and also the goods, chattels and other personal estate of said wards; to bring such suits or actions in relation thereto as may be deemed necessary" and in two years renew the bond and "upon arrival at full age" of the wards, "or sooner, if required, to make final settlement...to deliver and pay to the person lawfully authorized to receive the same, the residue of said estate, including the profits arising therefrom."

Note: These are the children of Henry and Sarah's daughter Mary Babb Spencer. In 1880 Henry Babb has in his household granddaughter Mattie Babb and grandsons "Austin" and Henry Spencer. The ink was very faded, so can't be sure of the name Austin. R.T. Smith is almost certainly Robert Thaddeus Smith who wed Henry & Sarah's daughter Emily Louise Caroline.

"Cora Alice Smith is the daughter of Robert Thaddeus Smith (1839-1910) and Emily Louise Caroline Babb (1846-1884)." Those dates put Emily Louise Caroline Babb (Smith) as a pretty good match for the Caroline listed as a child of Henry and Sarah Elizabeth, but with the way names are recycled...
